1. General provisions
1.1. These Terms of Sale apply between a customer placing an order in the online store at [PRODUCTION DOMAIN] and the Seller, Osaühing MÖÖBLIEXPERT GRUPP (registry code 11129866, VAT number EE101049478, address Narva mnt 40, Jõhvi, 41536, Estonia, email info@moobliexpert.ee; hereinafter the “Seller”).
1.2. The Terms apply to both consumers and business customers. Statutory consumer rights apply only to a natural person entering into a transaction for purposes unrelated to their economic or professional activities.
1.3. The legal relationship is also governed by the laws of the Republic of Estonia. If a term conflicts with a mandatory provision protecting consumers, the mandatory provision applies.
2. Products, prices and stock
2.1. Product descriptions, photographs, dimensions and technical information are provided as accurately as possible. A manufacturer may update a product or its packaging without changing its essential characteristics. Colours may differ slightly because of screen settings.
2.2. Prices are displayed in euros. The final price shown to consumers includes VAT. Depending on account settings and a pricing agreement, business customers may see the price agreed for their account; taxes and the order total are shown before confirmation.
2.3. Delivery charges are added to the product price and shown before the order is placed.
2.4. Stock and prices may be updated from business-software data. If a price is clearly incorrect because of a technical error or the ordered goods cannot be supplied, the Seller will contact the customer, offer a substitute or revised delivery time where possible, and if necessary cancel the order and refund amounts paid.
3. Placing an order and conclusion of the contract
3.1. To order, the customer adds products to the cart, chooses delivery and payment methods, enters the required information and confirms the order.
3.2. The customer is responsible for the accuracy of the submitted information. By confirming the order, the customer confirms having read the Terms of Sale and Privacy Policy.
3.3. The sales contract enters into force when the amount payable has been received, unless otherwise agreed under invoice, credit or customer-contract terms.
3.4. An automatic acknowledgement confirms receipt of the order. If the order cannot be fulfilled, the customer will be informed as soon as possible.
4. Payment
4.1. Orders may be paid for using the payment methods shown at checkout. Payments may be facilitated by a licensed payment-service provider.
4.2. The Seller does not collect or store the customer’s complete payment-card details. Payment is made in the secure environment of the payment-service provider.
4.3. Separately agreed written payment and credit terms may apply to business customers.
5. Delivery and collection
5.1. Goods may be ordered using the delivery methods offered for the particular cart or collected from the Seller.
5.2. If the cart contains a product unsuitable for a parcel locker, the entire order is assigned to courier delivery or collection. If an order contains a worktop or another collection-only product, collection applies to the entire order unless otherwise agreed.
5.3. The estimated delivery time is shown in the online store or order confirmation, or agreed with the customer. Unless another period has been agreed, the Seller fulfils a consumer order within the period prescribed by law.
5.4. The risk of accidental loss of or damage to goods passes to a consumer upon receipt. For a business customer, the delivery arrangements may follow a separate agreement.
6. Consumer’s right of withdrawal
6.1. A consumer may withdraw from a distance contract without giving a reason within 14 days after receiving the goods.
6.2. The withdrawal statement must be sent to info@moobliexpert.ee or submitted through the website form. The consumer may use the model form, but is not required to do so.
6.3. The consumer returns the goods no later than 14 days after submitting the withdrawal statement. The consumer bears the direct return cost unless the Seller has agreed to bear it or the goods do not conform to the contract.
6.4. The consumer is liable for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
6.5. The right of withdrawal does not apply in cases provided by law, including goods made or adapted to the customer’s personal requirements and goods inseparably combined with another item after delivery.
6.6. The Seller refunds payments in accordance with law no later than 14 days after receiving the withdrawal statement, but may withhold the refund until receiving the goods or evidence that they have been returned.
7. Non-conforming goods and complaints
7.1. The Seller is liable for non-conformity of goods sold to a consumer to the extent prescribed by law. A consumer may submit a claim concerning a defect within two years after delivery.
7.2. The Seller must be notified within a reasonable time after discovery of a defect by emailing info@moobliexpert.ee with the order number, description and photographs where possible.
7.3. The Seller is not liable for a defect caused by incorrect installation, use or maintenance, normal wear and tear, or failure to follow the manufacturer’s instructions, unless the cause is incorrect guidance supplied by the Seller or the law provides otherwise.
7.4. A separate agreement may govern a business customer’s inspection, notification and liability obligations. The two-year consumer claim period does not automatically apply to business customers.
8. Liability and force majeure
8.1. The parties are liable for breaches of their obligations as provided by law and their agreements.
8.2. The Seller is not liable for a breach to the extent caused by force majeure. This does not restrict a consumer’s statutory rights.
9. Personal data
9.1. The principles governing personal-data processing are described in the Privacy Policy. To fulfil an order, data may be disclosed to payment, delivery, business-software, IT and other service providers only to the extent necessary.
10. Complaints and dispute resolution
10.1. Questions and complaints should be sent to info@moobliexpert.ee. The Seller generally responds to a consumer’s written complaint within 15 days.
10.2. If a consumer and the Seller cannot resolve a dispute by agreement, the consumer may contact the Consumer Disputes Committee operating at the Estonian Consumer Protection and Technical Regulatory Authority (Endla 10a, 10122 Tallinn; https://ttja.ee/en/consumer-disputes-committee). Proceedings are free for the consumer.
10.3. Disputes are governed by Estonian law. Jurisdiction in consumer matters is determined by mandatory law; other disputes are resolved by agreement or in a competent Estonian court.
11. Amendments
11.1. The Seller may amend the Terms. Unless the law provides otherwise, an order is governed by the Terms in force when it was placed.
